Official Rules

1. Sponsor

Each promotional prize draw is made in connection with charitable fundraising campaigns (each, a “Campaign”) conducted on DailyDeed and sponsored by a verified 501(c)(3) nonprofit organization (each, a “Sponsor Charity”). The address of the Sponsor Charity may be found in the applicable Campaign Rules and is also available upon written request to support@dailydeed.us.

You acknowledge that any dispute relating to your participation in a Campaign (including, without limitation, prize fulfillment) shall be between you and the Sponsor Charity. You hereby agree to release and hold harmless DailyDeed from any and all claims that may arise or otherwise relate to your participation in any Campaign.

2. Eligibility

Each Campaign is open to legal residents of the United States who are at least eighteen (18) years of age at the time of entry. Employees, officers, and directors of the Sponsor Charity, its service providers, and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and prize suppliers, and their immediate family members (spouse, parents, siblings, children) and household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners, siblings (half and full) and the steps of each of the foregoing) (“Immediate Family Members”) of each of the above are not eligible to participate in any Campaign hosted and/or sponsored by the Sponsor Charity. Participation in Campaigns is subject to all applicable federal, state, and local laws and regulations and shall be deemed void where prohibited or restricted by law.

3. Campaign Period

Each Campaign begins and ends on the dates specified in the applicable Campaign Rules (“Campaign Period”). All entries must be received during the Campaign Period. DailyDeed’s services are the official timekeeping device for each Campaign. You acknowledge that DailyDeed shall not be liable or responsible for any failure or inability to complete a Campaign during the Campaign Period for any reason outside of DailyDeed’s reasonable control, including, without limitation, Sponsor Charity’s (i) stoppage or postponement of a Campaign, and/or (ii) failure to perform or satisfy necessary duties and obligations required to complete the Campaign.

4. How to Enter

4.1 Entry via Donation

During the Campaign Period, you may make a qualifying donation to the designated Sponsor Charity through DailyDeed. Upon completion of a qualifying donation, you will automatically receive entries into the associated prize draw relating to the Campaign as specified on in the applicable Campaign Rules. The number of entries received is based on the donation amount as described in the applicable Campaign Rules. All donations are charitable contributions to the designated Sponsor Charity and are non-refundable.

4.2 Free Alternative Method of Entry (AMOE)

You may also enter without making any purchase or donation by using the free alternative method of entry offered by DailyDeed. To obtain a free entry, visit the applicable Campaign page and select the free entry option. Unless otherwise specifically set forth in the applicable Campaign Rules, free entries are limited to one (1) per person per Campaign per day. Free entries carry the same odds of winning as entries received through a donation. No purchase or donation is necessary to receive a free entry or to win a prize.

4.3 Deed Bucks Entry

You may redeem Deed Bucks earned through participating in various promotional activities offered by DailyDeed for additional entries. Deed Bucks entries carry the same odds of winning as all other entries. Deed Bucks have no cash value, are not transferable, and may not be sold, transferred, assigned, gifted, traded, bartered, or exchanged. Use of any automated or other system(s) to acquire Deed Bucks is prohibited and will result in disqualification and loss of eligibility to participate in the Campaign and/or other Services.

5. Winner Selection and Notification

The winner of each Campaign will be selected via random prize drawing from among all eligible entries received during the Campaign Period. The drawing will be conducted by the Sponsor Charity or PMTS, LLC as the Sponsor Charity’s nominated service providers for the purpose of conducting Campaigns offered on DailyDeed. The odds of winning depend on the total number of eligible entries received for the Campaign during the applicable Campaign Period.

DailyDeed and/or the Sponsor Charity reserves the right to seek additional verification of eligibility or identity prior to satisfying any prize fulfillment request. This may include, but is not limited to, providing proof of a valid government-issued photo identification and/or proof of address. All decisions regarding verification of eligibility made by DailyDeed and/or the Sponsor Charity are final and binding.

The potential winner will be notified by email at the email address provided during account registration. The potential winner must respond to the notification within seven (7) days or the prize may be forfeited and an alternate winner selected. The Sponsor Charity may request DailyDeed conduct up to three (3) alternate drawings.

6. Prizes

The prize for each Campaign is described in the applicable Campaign Rules. The approximate retail value (“ARV”) of each prize is stated in the applicable Campaign Rules. You acknowledge that the Sponsor Charity is solely responsible for ensuring that prizes awarded from a Campaign are fulfilled, shipped and/or otherwise distributed to the winning participant. No substitution, transfer, or cash equivalent of a prize is permitted; provided, you acknowledge that the Sponsor Charity reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

7. Publicity Release

By participating in a Campaign and except as otherwise prohibited by applicable law, you hereby grant DailyDeed, the Sponsor Charity, and each of their respective affiliates, suppliers, licensors and licensees an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display your name, voice, pictures, images, likeness, and/or biographical information relating to your account for advertising, marketing and other purposes as determined by DailyDeed and/or the Sponsor Charity without further approval or compensation, and in any and all forms of media, whether now known or hereafter devised.

The potential winner may be required to complete and return an Affidavit of Eligibility, Liability Release, and (where permitted by law) a Publicity Release within fourteen (14) days of notification. Failure to comply may result in forfeiture of the prize.

8. Taxes

The winner is solely responsible for all federal, state, and local taxes on the prize. DailyDeed and/or the Sponsor Charity will issue an IRS Form 1099 for prizes valued at $600 or more, as required by law.

9. General Conditions

DailyDeed and/or the Sponsor Charity reserve the right, in its sole discretion, to cancel, terminate, modify, or suspend any Campaign if fraud, technical failures, or any other factor beyond the Sponsor Charity’s reasonable control impairs the integrity or proper functioning of the Campaign. In such event, the Sponsor Charity may (but is not obligated to) select the winner from among all eligible entries received during the applicable Campaign Period prior to the cancellation.

DailyDeed and/or the Sponsor Charity reserve the right to disqualify any entrant who tampers with the entry process, violates these Official Rules, or acts in a disruptive or other manner that affects the integrity of the Campaign and/or DailyDeed’s ability to provide the Services.

10. Limitation of Liability

By participating in a Campaign and/or otherwise accessing the Services, you agree to release, indemnify, defend, and hold harmless DailyDeed, the Sponsor Charity, and each of the foregoing’s parent companies, subsidiaries, affiliates, officers, directors, employees, and agents (collectively, the “Releasees”) from any and all liability, claims, demands, or causes of action arising out of or related to participation in the Campaign or acceptance, use, or misuse of any prize.

You acknowledge that DailyDeed, the Sponsor Charity, and the Releasees are not responsible for any incorrect or inaccurate information, whether caused by the Services, you, or by any of the equipment or programming associated with or utilized in conducting a Campaign and shall not be responsible for (i) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in a Campaign, (ii) any error, omission, interruption, deletion, defect, or delay in operation of a Campaign or any Services related thereto, (iii) any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions or failures, problems with connections or availability, (iv) garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, (v) traffic congestion, (vi) unauthorized human intervention, or (vii) theft or destruction, tampering, or unauthorized access to entries and/or entry information. If, for any reason, a Campaign is not capable of running as planned by reason of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond DailyDeed, the Sponsor Charity, and/or the Releasees control, DailyDeed and/or the Sponsor Charity reserves the right, in its sole discretion, to cancel, terminate, modify or suspend such Campaign.

In no event will DailyDeed be responsible or liable for any damages or losses of any kind, including indirect, incidental, consequential or punitive damages, other than a user’s actual out-of-pocket expenses arising out of your use of the Services. Without limiting the foregoing, all Services are provided “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.

Some jurisdictions may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.

11. Disputes

All disputes arising out of or relating to these Official Rules or the Campaign shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal proceedings shall be brought exclusively in accordance with the arbitration agreement set forth in Section 18 of our Terms of Service.

12. Privacy

Information collected from entrants is subject to DailyDeed’s Privacy Policy, available at https://www.dailydeed.us/legal/privacy.

13. Winner List

For the name of Campaign winner(s), please email DailyDeed within sixty (60) days (or such other timeframe as required by applicable law) after the end of the applicable Campaign Period: DailyDeed. Winner List Request, at support@dailydeed.us.
